Service scope (app and web)

The Service includes our website, web app, mobile apps, and related services and support channels.

• Using the Service requires a compatible device, updated software, and an internet connection.
• Mobile app downloads and payments may be handled by third-party app stores and are also subject to their terms.
• We may release updates, changes, or remove features to improve security and performance.

Who can use Flownize

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you use the Service on behalf of a company, you confirm that you have authority to bind that company to these Terms.

Account registration and security

• You must provide accurate, complete, and up-to-date information.
• You are responsible for keeping your login credentials secure and confidential.
• You are responsible for all activity under your account and any accounts you administer.
• Notify us immediately if you suspect unauthorized access or a security incident.

Acceptable use

You agree to use the Service lawfully and in line with these Terms and our documentation. You must not:

• Violate any applicable law, regulation, or third-party right.
• Upload or share unlawful, harmful, or misleading content.
• Attempt to gain unauthorized access or interfere with the Service or other users.
• Transmit malware, spam, or conduct abusive or disruptive behavior.
• Reverse engineer, decompile, or attempt to bypass security or access controls.

We may suspend or terminate access if these rules are violated.

Customer data and user content

• You retain ownership of the content and data you submit to the Service ("User Content").
• You grant Flownize a limited, non-exclusive license to process, store, and display User Content to operate and improve the Service.
• You are responsible for ensuring you have the rights to upload and use the User Content.
• We may remove or restrict content that violates these Terms or the law.

Intellectual property

• Flownize owns all intellectual property rights in the Service, including software, design, trademarks, and content (excluding User Content).
• We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
• You may not copy, modify, distribute, sell, or lease any part of the Service without written permission.

Availability, changes, and beta features

• We aim for high availability, but the Service may be unavailable due to maintenance, outages, or factors outside our control.
• We may change, suspend, or discontinue parts of the Service at any time.
• Some features may be labeled beta and provided without guarantees.

Fees, subscriptions, and payment terms

• Some features are paid. Prices, billing frequency, and taxes are shown at checkout or in your subscription plan.
• Subscriptions may renew automatically unless canceled before the renewal date.
• Payments may be processed by third-party providers or app stores and are subject to their terms.
• Refunds are provided only when required by law or expressly stated in the purchase terms.

Privacy and GDPR

We process personal data in accordance with the GDPR and Norwegian law. Flownize is the data controller for account and administrative data and a data processor for customer data handled on behalf of business customers.

• Our Privacy Policy explains what data we process, purposes, legal bases, retention, and your rights.
• Business customers can request a data processing agreement (DPA).
• You are responsible for informing your users or employees about your processing activities.

Third-party services and links

• The Service may integrate with third-party services such as app stores, payment providers, analytics, and communication tools.
• We are not responsible for third-party content, policies, or practices.
• Your use of third-party services is governed by their terms and privacy policies.

Termination

• You may stop using the Service at any time.
• We may suspend or terminate your access if you breach these Terms or misuse the Service.
• Upon termination, your access to the Service will end and data may be deleted in accordance with the Privacy Policy.

Disclaimer and limitation of liability

• The Service is provided "as is" and "as available" without warranties of any kind.
• We do not guarantee that the Service will be uninterrupted, error-free, or meet your requirements.
• To the fullest extent permitted by law, Flownize is not liable for indirect, incidental, special, or consequential damages.
• Our total liability is limited to the amounts you paid to Flownize in the 12 months prior to the event giving rise to the claim.

Indemnity

You agree to indemnify and hold harmless Flownize AS, its affiliates, officers, employees, and partners from claims arising from your use of the Service, your User Content, or your violation of these Terms.

Changes to these Terms

We may update these Terms from time to time. We will notify you of significant changes via the Service or email. Your continued use of the Service after changes means you accept the updated Terms.

Governing law and disputes

These Terms are governed by Norwegian law. Any disputes shall be subject to the courts of Bergen, Norway.
